CONTENT DISPUTE & INTELLECTUAL RIGHTS POLICY

This Content Dispute & Intellectual Rights Policy (“Policy”) explains how WhaTalker manages complaints and disputes regarding content, including alleged infringements of intellectual property rights. It applies to all WhaTalker users, content providers, and rights holders. By using WhaTalker, you agree to comply with this Policy, our Terms of Service, and all applicable laws.

 

TYPES OF DISPUTES COVERED

WhaTalker may remove, restrict, or block access to content under the following circumstances (without limitation):

  • Copyright or Trademark Infringement: Upon receipt of a valid notice from a rights holder or their agent.
  • Violation of Terms or Community Guidelines: Content that breaches our Terms of Service or Community Guidelines (e.g., hateful, illegal, or harmful content).
  • Illegal, Harmful, or Offensive Material: Allegations that the content violates applicable laws or poses a significant risk to users.
  • Request by Authorities: Compliance with legally binding orders or requests from competent authorities.

Content actions are taken in good faith. Where possible, the user who posted the content will be notified of the removal or restriction.

 

REPORTING INFRINGEMENT (INTELLECTUAL RIGHTS PROTECTION PROCEDURE)

If you believe that content on WhaTalker infringes your copyright, trademark, or other intellectual property rights, you may submit a formal complaint to our Designated Agent. Your complaint (notice) must include the following:

  1. Identification of Authorized Person: An electronic or physical signature of the person authorized to act on behalf of the rights holder.
  2. Detailed Description of the Infringed Work: A clear identification or description of the copyrighted or protected material.
  3. Location of the Infringing Material: The precise URL or reference where the allegedly infringing content appears.
  4. Contact Information: Your full name, mailing address, telephone number, and email address.
  5. Statement of Unauthorized Use: A good faith declaration that the use of the material is not authorized by the rights holder, its agent, or the law.
  6. Declaration Under Penalty of Perjury: A statement that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

Legal Reminder:

Filing a claim that is knowingly false or deceptive can carry legal consequences. This may include accountability under Section 512(f) of the U.S. Copyright Act, which addresses misuse of the notice process.

 

DISPUTING CONTENT REMOVAL (USER RIGHTS & COUNTERCLAIMS)

If your content is removed or blocked due to an alleged violation or IPR claim and you believe this action is in error, you may submit a Content Dispute Request (or counter-notice, if based on IPR). Your request must include:

  1. Identification of Removed Material: A description or reference to the material that was removed or blocked and its location before removal.
  2. Explanation: A clear statement of why you believe the content does not violate any rights or policies, or why the IPR claim is mistaken.
  3. Evidence or Documentation: Any supporting evidence, such as proof of ownership, license, or consent.
  4. Account & Reference Information: Provide your account email and any reference number stated in the removal notification.
  5. Statement Under Penalty of Perjury (IPR Counter-Notice): A declaration that you believe in good faith the content was removed due to a mistake or misidentification. You must also consent to the jurisdiction of the appropriate court and agree to accept service of process from the complainant.

REVIEW & RESOLUTION PROCESS

  • Initial Review: WhaTalker will review the complaint or counter-notice to determine if it meets the necessary requirements.
  • Notification & Investigation: If valid, we will investigate and may contact involved parties for more information.
  • Decision Timeline: A decision is typically issued within 10 business days, though complex matters may require more time.
  • Outcome:
    • Restoration of Content: If no violation is confirmed.
    • Permanent Removal: If the violation is upheld.
    • Account Warnings/Restrictions: In cases of repeated or egregious violations.
    • Referral to Authorities: When legally required.

All decisions made during the dispute process are final unless superseded by a legal order.

 

REPEAT OFFENDERS & ACCOUNT ACTIONS

WhaTalker enforces a strict Repeat Infringer Policy. Users or accounts associated with multiple or egregious violations (including intellectual property infringements) may be suspended or permanently terminated without prior notice.

 

LEGAL NOTICES & DISCLAIMERS

  • No Legal Advice: This Policy is provided for informational purposes only and does not constitute legal advice.
  • False Claims: Submitting false or misleading claims (whether a complaint or counter-notice) may result in legal liability.
  • No Mediation of Private Disputes: WhaTalker is not a court of law and does not mediate private content ownership disputes beyond what is reasonably verifiable.
  • Policy Changes: WhaTalker reserves the right to modify this Policy and related procedures at any time without prior notice.

USER CONTENT RESPONSIBILITY & PUBLICATION TERMS

WhaTalker allows individuals to share and publish their own original content through the platform. While we support open expression and creativity, each user is entirely responsible for the content they upload, share, or make accessible to others, as well as for any consequences resulting from such actions.

Key Guidelines for Content Publication:

  • Public Visibility: Any content you choose to make public on WhaTalker may be accessible on external websites and indexed by search engines.
  • Privacy Awareness: You are solely responsible for ensuring that you do not publish private, confidential, or sensitive information unintentionally.
  • Third-Party Material: Content published by other users is provided “as is” for personal and informational purposes only. You may not copy, distribute, commercialize, or otherwise use such content without the prior written consent of the original rights holder.

Protection of Rights and Legal Assurance:

  • If you encounter content containing copyright statements, watermarks, or technical protection measures, you may not remove, bypass, or disable those mechanisms.
  • By uploading any material, you confirm that you have the legal rights, licenses, or necessary permissions to publish it in that form.

Disputes and Platform Actions:

If WhaTalker receives a valid complaint regarding the use of copyrighted or unlawful content, we may restrict access to or remove the reported material while the matter is investigated.
WhaTalker, or a designated agent, retains the right to assess whether content violates any legal or intellectual property rights.
