By enabling this integration, users agree to comply with OpenAI’s terms, ensure responsible usage, and manage their own billing with OpenAI directly.

Welcome to WhaTalker. This document sets forth the terms and conditions governing the use of our integration with the OpenAI API, which powers artificial intelligence features in our chatbot. By using this integration, you enable advanced AI-driven communications as part of our multichannel CRM platform.
The platform is operated by WhaTalker Inc., a corporation registered in the State of Delaware, United States, and adheres to legal frameworks including the CAN-SPAM Act (USA), the General Data Protection Regulation (GDPR) for users in the European Union, and applicable data protection regulations across Latin America. Your continued use of the integration constitutes full acceptance of the terms outlined below.

2.2. You are solely responsible for safeguarding your credentials and ensuring secure access. Any unauthorized use must be reported to WhaTalker without delay.
2.3. WhaTalker is not responsible for any damage, loss, or liability arising from compromised credentials due to user negligence.
3. Third-Party Service Integration
3.1. The OpenAI API integration may rely on services and infrastructure provided by OpenAI and other third-party providers.
3.2. Use of third-party services is governed by their own terms of service and privacy policies. It is your responsibility to read and accept those terms before enabling integrations.
3.3. WhaTalker assumes no liability for the availability, reliability, or security of third-party tools or for interruptions caused by such dependencies.
4. Data Handling and Privacy
4.1. Data processed by the integration is handled in accordance with WhaTalker’s Privacy Policy, which aligns with major international standards, including GDPR, CAN-SPAM, and LATAM regional regulations.
4.2. You are responsible for ensuring that any data submitted through the integration is collected lawfully and that its processing complies with the applicable legal framework in your jurisdiction.
4.3. The integration may involve temporary transmission or transformation of personal data; users must implement and respect consent, transparency, and security practices as required by law.
5. API Usage and Account Requirements
5.1. Although WhaTalker does not currently enforce specific usage limits on the OpenAI API integration, continued access requires a valid and properly configured OpenAI account.

6.2. WhaTalker makes reasonable efforts to provide a stable and reliable experience but does not guarantee uninterrupted service or freedom from errors.
6.3. To the fullest extent permitted by law, WhaTalker shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from use of or inability to use the integration.
6.4. Users are responsible for ensuring their usage of the integration complies with all applicable legal requirements, including, but not limited to, those related to data protection, digital marketing, and AI transparency.
7. Modifications to Terms

7.2. Material changes will be announced via email or in-app notifications. Continued use of the integration after changes constitutes your acceptance.
7.3. If you disagree with the changes, you must discontinue use of the integration and may request account closure.
