Welcome to WhaTalker. This document defines the terms and conditions governing the use of our platform, operated by WhaTalker Inc., a corporation registered in the State of Delaware, United States, which primarily focuses on managing client relationships via WhatsApp, while also integrating an Advanced Module that enables multichannel communications such as email, SMS, push notifications, forms, webhooks, and other marketing and customer service channels.
Our goal is to help you centralize customer service, streamline your sales and marketing processes, and increase the efficiency of your communications from a single place. By using our services, you fully accept the terms described below and agree to comply with applicable regulations in your jurisdiction, including but not limited to the CAN-SPAM Act (USA), the General Data Protection Regulation (GDPR) for users in the EU, and data protection regulations in Latin America.
🟢 1. WHATALKER TERMS OF USE
1.1. By using WhaTalker, our Customer Relationship Management (CRM) system designed exclusively for WhatsApp, you agree to comply with these Terms of Use, as well as any additional policies that WhaTalker may issue. If you do not agree with these terms, please refrain from accessing or using the platform.
1.2. Creating an account on WhaTalker implies your commitment to use the service responsibly, in full compliance with applicable laws, and to avoid any practice that may compromise security, privacy, or the proper functioning of the platform.
1.3. WhaTalker reserves the right to refuse or cancel user registrations that violate these Terms of Use or any current legal regulations in the United States, EU, or Latin America.
2. Access to WhaTalker
2.1. Your user account allows you to use the features enabled within the WhaTalker platform. Some features may require additional configurations, special permissions, or paid add-ons.
2.2. You are responsible for maintaining the confidentiality of your access credentials and for all activities that occur under your account. You must immediately notify WhaTalker if you suspect any unauthorized use of your account.
2.3. WhaTalker is not liable for any loss or damage arising from your failure to comply with your obligations regarding credential security unless such damages result from the platform’s gross negligence.
3. Third-Party Integrations
3.1. WhaTalker may include integrations with third-party applications or services. Use of these integrations implies your acceptance of the terms of service and privacy policies of those third parties.
3.2. WhaTalker assumes no responsibility for the availability, performance, or security of third-party services.
4. Message Sending and Anti-Spam Policy
4.1. All messages sent through WhaTalker must comply with responsible use guidelines and international anti-spam regulations (e.g., CAN-SPAM Act, GDPR, LATAM equivalents).
4.2. Sending spam or unlawful, offensive, or defamatory content is prohibited. WhaTalker may suspend accounts that violate this policy.
4.3. Users are solely responsible for ensuring all messaging complies with applicable data protection and privacy laws.
5. Email Add-On
5.1. If the email functionality is enabled, some messages may be visible to other system users depending on permissions.
5.2. The email add-on is subject to the same anti-spam and compliance policies outlined in Section 4.
6. Voice and SMS Features
6.1. Voice and SMS services depend on the plan subscribed. These are not to be used for emergency services.
6.2. Users must comply with local laws regarding SMS and call communications. WhaTalker does not guarantee uninterrupted access to third-party-dependent services.
7. Usage Limits
7.1. WhaTalker does not impose hard limits on the number of contacts or messages, but limits apply based on your subscription tier and number of WhatsApp accounts connected.
7.2. Exceeding usage limits may result in account downgrade or temporary suspension.
8. Advanced Features and Multichannel Module
8.1. Advanced features (email, SMS, push, etc.) require purchasing and configuring the Advanced CRM Module.
8.2. Users must ensure proper technical integration. WhaTalker is not liable for implementation errors.
8.3. All data processed through the module must comply with data protection laws relevant to your country or region.
9. Liability and Warranties
9.1. WhaTalker is provided “as is” without warranties of merchantability or fitness for a specific purpose.
9.2. We do not guarantee uninterrupted service or error-free functionality, though we will make reasonable efforts to resolve issues quickly.
9.3. Users are fully responsible for data privacy compliance, including lawful data processing and communication practices.
10. Modification of Terms
10.1. WhaTalker reserves the right to amend these terms at any time. Continued use implies acceptance of the updated terms.
10.2. Substantial changes will be communicated via in-app notices or email where possible. Users are responsible for reviewing these terms periodically.
